Article 1 - Presentation of the general conditions of use

The purpose of these general conditions of use (known as “CGU”) is to provide a legal framework for the terms of provision of the site www.africafans.co (hereinafter referred to as “the site”) and their use by “the User "

The general conditions of use must be accepted by any User wishing to access the site. They constitute the contract between the Company Java sas and the User. Access to the site by the User signifies acceptance of these general conditions of use

In the event of non-acceptance of the general conditions of use stipulated in this contract, the User must renounce access to the services offered by the site

Article 2 - Legal notice

The site africafans.co  was created by the company Java Sas.  It is hosted by O2switch.

The Java Sas is headquartered Perpignan, France

Article 3 - Definition

The purpose of this clause is to define the various essential terms of the contract:

User: this term designates any person who uses the site or one of the services offered by the site

User content: this is the data transmitted by the User within the site

Member: the User becomes a member when he is identified on the site

Article 4 - Access to services

The africafans.co site offers the following services:

-Webcam
-Sale of photos and videos
-Podcast
-All services are available free of charge to all Users. However, some services are reserved for members. To do this, the User must identify themselves using their username and password

The site implements all the means at its disposal to ensure quality access to its services. The obligation being of means, the site does not undertake to achieve this result

Any event due to force majeure resulting in a network or server malfunction does not engage the responsibility of africafans.co

Access to the site's services may at any time be subject to interruption, suspension, modification without notice for maintenance or any other case

The User undertakes not to claim any compensation following the interruption, suspension or modification of this contract

Article 5 - Intellectual property

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited without the prior written permission of the rights holders

Any unauthorized use of the site or any of the elements it contains will be considered as constituting an infringement and prosecuted in accordance with the provisions of articles L.335-2 et seq. of the Intellectual Property Code

Article 6 - Liability

The Company Java sas cannot be held responsible for direct or indirect damage caused to the User's equipment when accessing the africfans.co site, and resulting either from the use of equipment that does not meet the requirements. specifications indicated in point 4, or the appearance of a bug or incompatibility

The Company Java sas  cannot also be held liable for indirect damage (such as loss of market or loss of opportunity) resulting from the use of the africafans.co site

Interactive spaces (possibility of asking questions in the contact area) are available to users. The Company Digital Interactive Group sas reserves the right to delete, without prior notice, any content posted in this space which contravenes the legislation applicable in France, in particular the provisions relating to data protection. Article 7 - Hypertext links

Hypertext links may be present on the site. The User is informed that by clicking on these links, he will leave the africafas.co site. The Company Java sas cannot be held responsible for the content of the sites visited, and cannot bear any responsibility for the results which could possibly result from this visit

The establishment by the User of any hypertext links to the africafans.co site is strictly prohibited, without prior written authorization from the Company Java sas

Article 8 - Evolution of the contract

Java Sas reserves the right to modify the clauses of this contract at any time

The User undertakes to refer regularly to this section in order to be informed of the nature of any changes made

Article 9 - Duration

The duration of the present contract is indefinite. The contract takes effect with regard to the User from the time of use of the service

Article 10 - Applicable law and jurisdiction

French law applies to the present contract. In the event of a dispute not amicably resolved between the User and Java Sas, the French courts shall have jurisdiction to settle the dispute.

Article 11 - Publication by the User

The africafans.co site allows members to publish: comments, podcasts, photos, videos, etc... In his publications, the User undertakes to respect the rules of law in force

The User agrees not to publish content that may be considered illicit, contrary to public order or defamatory.
